Please read this carefully.

BY PURCHASING ON THIS WEBSITE YOU ARE AGREEING TO THE FOLLOWING TERMS AND CONDITIONS:

To register with, and shop at nandis-shop.com you must be eighteen years of age or over.

These Terms and Conditions were amended on 07 July 2007.

1. PURCHASE CONTRACT
1.1 This web site is owned and operated by Nandis Limited. All purchases made on this web site are governed by these Terms and Conditions which may be amended from time to time. To assist you in determining any changes to these Terms and Conditions we will display the date of amendment to these Terms and Conditions, which thereafter governs all purchases.

1.2 We sell goods only to end-user consumers. All goods are sold subject to the condition that they will not, in any way, be re-sold or otherwise circulated without our prior written consent.


1.3 We will confirm acceptance of your order by message on the website immediately after you have confirmed your order, or by e-mail message to the email address you have stipulated We may do both, in which case, order acceptance will occur on whichever of the web message or email message arrives soonest. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.

1.4 You must be 18 years old or over and have completed the registration process in order to purchase on this web site.

1.5 English law places certain restrictions on transactions involving alcohol.  Accordingly, alcohol must be ordered by you and delivered by us during normal licensing hours. If you have ordered alcohol from us and cannot be at the stipulated delivery address at your selected delivery time, it is your responsibility to ensure that a responsible person is there to receive the order.

2. PRICE AND DELIVERY CHARGES
2.1 The price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the "checkout" button) subject only to any inadvertent technical error for which we will not be held liable. If you subsequently amend your order, the prices charged will be those applicable to the amended item(s) at the time that the amended order is confirmed. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer valid.

2.2 Where items are ordered and sold individually by weight (such as biltong) the price of these items will be the price on the date that they are packed for you.

2.3 The prices stated on the website are VAT inclusive.

2.4 The prices exclude delivery charges.

3. METHODS OF PAYMENT
3.1 We accept payment by debit, credit or charge card, postal order or cheque (we must have cleared funds prior to dispatch). There is no minimum order.

3.3 Those debit and credit cards accepted by us are listed on the web site on the date on which your order is placed.

3.3 You agree to indemnify us in full against all costs, expenses and outgoings incurred by us in obtaining payments from you in the event of a failed payment. This will include an administration charge of not less than £20. At any time after a failed payment we reserve the right to engage a collection agency to secure payment, the costs of which shall be to your account.

4. DELIVERY
4.1 Delivery will be made to the address stipulated in your registration on the website. You have the ability to change the delivery address through the “My Account” feature on the website, which you must maintain to ensure a correct delivery address.

4.2 We will always try to supply you with the full quantity that you have ordered. In the event that the goods delivered to you are incomplete or include incorrect goods, you must notify us promptly and in any event within 48 hours of receipt of the goods. If you are not satisfied with the quantity or quality of goods you have received we will arrange with you for these to be returned to us (please note that the goods must not be used and must be in the condition they were received and in their original packaging). You will not be charged for any incorrect goods or goods which you have not received. In any event, our liability is limited to the price of the goods not delivered or incorrectly delivered, and the cost of delivery.

4.3 We take special care to endeavour that orders are delivered to you within a time frame agreed between yourselves and the company.


5 DEFECTIVE GOODS & RETURNS
5.1 We guarantee the quality of our goods, however you must inspect the goods on receipt and notify us within 48 hours of any dissatisfaction with your order

5.2. No credit or refund will be given for any goods ordered in error by the customer. No credit or refund will be given for any losses due to incorrect storage or handling by the customer of goods supplied by nandis-shop.com

5.3. If you are not satisfied with any product or service provided by nandis-shop.com please contact us at 01227 452244 or email nandis@btconnect.com and  we will endeavour to resolve any complaint as soon as possible. If goods are found to be faulty or different from those ordered by the customer, we will offer an appropriate credit or refund solely at our discretion; this will be done within seven days of agreeing to give the credit or refund. Any mistakes in bills, receipts or payments will be rectified as soon as possible and within seven days of agreeing to do so.

5.4. Non-perishable items purchased by customers and supplied in good order can be returned to nandis-shop.com 49 Northgate, Canterbury, Kent, CT1 1BE for a full refund, provided that the goods are returned unused and in their original packaging within 7 days of having been received from nandis-shop.com. In cases where the correct item has been supplied and the customer changes his mind the cost of returning the item will be paid for by the customer.

5.5 Subject to clause 7 and upon refunding your monies or replacing the goods, we will not accept any further claims for loss from or in connection with the supply of faulty goods, whether direct, indirect, consequential or otherwise, howsoever arising.

6 AMENDMENT OF ORDERS AND CANCELLATION RIGHTS
6.1 You may amend your order at any time prior to dispatch, provided amendments are notified by telephone.

6.2 In respect of non-perishable items, you may cancel the order no later than 24 hours prior to the anticipated dispatch date, provided such cancellations are done by telephone.

6.3. In the case of perishable items you do not have the right to cancel the order.

6.4 Orders cancelled outside the period mentioned at clause 6.2. herein will incur an administration charge equal to 10% (ten percent) of the invoice value of the order.

7 WARRANTY AND LIABILITY
7.1 Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, neither will any of these terms restrict any of your statutory rights.

7.2 In addition to paragraph 4.3 we will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.

7.3 Other than as set out in clause 7.1, our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.

8 PRIVACY
8.1 We are committed to protecting your privacy, and will only use the information we collect about you lawfully, and in accordance with the Data Protection Act 1998 and the Which? Web Trader Code of Practice. We collect information about you only to process your order and to provide you with the best possible service. The type of information we will collect about you includes: your name, physical address, telephone number and email address. The personal information that we hold is held securely in accordance with our internal security policy, the law and the Which? Web Trader Code of Practice. We do not sell, rent or transfer this information to third parties for their marketing purposes unless you agree otherwise.

8.3 At the time of your registration you will receive a password. Please keep this secret, as you are entirely responsible for all orders placed with us or information given to us under your email address in combination with your password. You must immediately notify us of any unauthorised use of your email address and/or password or any breach of security known to you.

10 GENERAL
10.1 If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

10.2 All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only for your personal use in placing orders through nandis-shop.com, and you may not copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

10.3 These Terms and Conditions are governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them. nandis-shop.com is operated by Nandis Limited, 49 Northgate, Canterbury, Kent, CT1 1BE.
